Questions about Land at Meadow Lane (SPS8):

  • A brief explanation of the terms used for soundness and legality.
  • Suggested responses to use for the section on the Horse Fields allocation (Land at Meadow Lane SPS8), to convey that you believe it is unsound and not legal. You can use these verbatim but ideally please adapt in your own words as far as possible.

Explanation of terms used for soundness (1 – 3) and legality (4)

1. Policy is positively prepared

Policy provides a strategy which, as a minimum, seeks to meet objectively assessed needs and is informed by agreements with other authorities and is consistent with achieving sustainable development.

2. Policy is justified

Policy is an appropriate strategy, taking into account the reasonable alternatives, and is based on proportionate evidence.

3. Policy is effective policy

Policy is deliverable over the Plan period.

4. Policy is consistent with national policy

Policy enables sustainable development consistent with the National Planning Policy Framework (NPPF) and other relevant Policies.

Policy is NOT positively prepared
It is not positively prepared as it disregards and misinterprets the clear evidence that has emerged that this site is not suitable for sustainable development. The policy appears to seek to rely on a flawed assumption that because it was in Local Plan 2036 that this is sufficient.  Any development here is unsustainable and would cause very high levels of harm to the ecology, and to the rural Iffley Conservation Area, which can neither be justified nor mitigated. Access is difficult and would endanger users of the Principal Quiet Route for Active Travel along Meadow Lane and Church Way. The site is partly in Flood Zone 3 and there is an ongoing objection from the Environment Agency. 

Policy is NOT justified
The site has no minimum housing allocation (i.e. a ‘zero’ allocation). The Council is therefore accepting that the site is so constrained that it may be unable to deliver any development in a sustainable and/or policy compliant manner. It is therefore unjustifiable to allocate it. 
The new evidence from the Council’s own surveys since the Horse Fields was allocated to the current Local Plan 2036 shows how sensitive this site is: 15 constraints have been identified – the highest number of any site on the new Local Plan.
The reasonable alternatives for housing in Oxford are on the brownfield sites currently designated for employment. A new employment policy (Policy E1) makes it possible for land-owners to deliver housing alongside employment on these sites. It would be even more effective to redesignate them for housing, particularly as there have been so many ‘windfall’ sites for new tech companies in redundant retail and offices e.g. Clarendon Centre, Botley Road.

Policy is NOT effective
Again, a zero allocation makes no guaranteed or reliable contribution to meeting housing needs and so cannot be effective. Oxford City Council have not been able to deliver housing on the Horse Fields over the 5 year period of the current Local Plan. They have now learnt about how sensitive the site is, in particular for ecology, the conservation area and access and have reduced the number of houses on the allocation from 32 to effectively zero, with no certainty of being able to deliver any housing  at all. This is clearly not an effective policy.

The fact that the policy is not positively prepared, effective or justified means that it cannot meet the tests of soundness or legal compliance.

Any development at Land at Meadow Lane SPS8 (known locally as the Horse Fields) would be unsustainable and cannot be delivered in a viable fashion in accordance with local and national policy. This makes the allocation unsound, and site SPS8 should be deleted from LP 2045

UPDATE on PUBLIC CONSULTATION on the PROPOSAL TO BUILD ON THE HORSE FIELDS

The proposal: 32 homes on the Horse Fields, with the entrance for 30 on Meadow Lane, and 2 on Church Way. Build is for 161 people,
for whom only 15 car parking spaces (including car-share) are offered, with an additional 2 spaces for the houses off Church Way.

Allocation of the site in the Council’s Local Plan 2036 was contingent on several factors, including: (1) the development would
‘enhance and protect’ the Iffley Conservation Area, and (2) biodiversity would be ‘preserved and enhanced’. The OxPlace proposal currently fulfils neither of these criteria.

The Case Officer has informed FOIV that OxPlace’s ‘application is not in a position to be determined in its current form’. He is ‘awaiting revisions to a range of documents based on consultee responses which will each need to be reviewed.’ The application will not go to the Planning Committee in March, and indeed, given that ‘a comprehensive set of new information’ has been requested of the Applicant, the earliest realistic date would be May, though it ‘will likely be later than that.’

‘Consultee responses’ include an independent Planning Assessment, commissioned by the Iffley Crowd Fund, five expert reports commissioned by FOIV or offered pro bono, and reports by Iffley Village residents with relevant expertise. These reports are available on the FOIV website, and on the Oxford Planning Applications website. We recommend starting with MWA Planning Assessment conclusions: 7 points outlining why permission should be refused (pp. 43-44). This Assessment, plus our experts’ reports point to numerous deficiencies in OxPlace’s Application.

An unprecedented number of people, more than 1100, also sent in individual responses, of which the overwhelming majority object to the Application. These responses come from Iffley and the wider East Oxford area, from all over Oxford, as well as from national and international visitors with connections to the village. The historic, rural character of Iffley, and its quiet green lanes are much loved locally and further afield.

Court Place

Monthly community liaison meeting with Feltham continues.

I am pleased to report that Site Manager Pete McCarthy is back on site though working part time.

Feltham’s are planning to hold an event to allow those interested to have a tour of the site. This could be around Easter.

OUD have shared preliminary hoarding designs for East Gate and Rivermead Road. The ideas and information we sent have been taken into account in developing the design. OUD are keen to finalise the design and enhance the site with a hoarding that provides useful information for the public.

Court Place

In the short term the contact for Court Place is now Adam Jervis, 07824 465328 as due to illness Pete McCarthy isn’t on the project, we wish him a speedy recovery. A new Site Manager joins the project from 30th January.

The SSE, electricity works in East Church, are now programmed to be undertaken by 1st February. This is likely to involve excavation work and vehicles using the village.
Thames water also have work to do in East Church but they haven’t been able to give Felthams a date for this.

    Utilities

    Some of you may have seen Saron Enterprises working on the Iffley streets. They are installing a fibre optic system. There may be excavation work in East Church. This is nothing to do with Felthams construction activities.

    Court Place

    • SSE could be undertaking electricity supply work in East Church w/b 16th
    • Thames water will be working on Rivermead Road for 2-3 days starting 11th
    • Felthams are meeting, this week, with Thames Water to find out when they will do work in East Church.

    Horse Fields

    OxPlace has submitted its application to build 32 homes, from maisonettes to 5-bedroom houses, on the Horse Fields. Their brochure is available online here:

    Donnington Cycle Track – As a result of FOIV lobbying a decision on this will now be taken by the Planning Committee, rather than through delegated powers to the Planning Officer. We will let you know the date.


    Court Place

    As this drone shot shows, construction of the foundations for the blocks has started.

    At our request Felthams have kindly trimmed the hedge on East Church and cleared the pavement of leaves.

    There is a restriction that no vehicles associated with the construction can use the village. We are aware of two instances of delivery vehicles contravening this. And in Rosehill vehicles are not always using the designated delivery route. With the support of Jeremy the OUD/L&G JV’s Project Manager FOIV are addressing these and other issues with Felthams senior management.

    Formation of new footpath and cycle path and associated landscaping

    Which includes cutting down a number of the trees that form presently a copse on Meadow Lane to make room for a new exit. The questions for local residents are: is this an effective way of protecting the playing fields from being crossed by pedestrian and cycles? And will the new proposed sloping exit lead to added danger for users of the Quiet Route from cyclists (or possibly even motorcyclists) exiting too fast on to Meadow Lane?

    IMPORTANT UPDATES

    Horse Field Planning Application for 29+ homes is going live The Council’s developers, OX Place, have completed a pre-application with the Local Planning Authority which it contends is ‘a complete, robust and compelling application’. OXPlace expects formal submission prior to Christmas. The plannerTemplars Square – REDEVCO, the new owners, want to hear our views. A scheme was given planning approval in 2016 for the redevelopment of the site. The first drop in session is November 19th.     Prince of Wales’s future Is this a tenancy issue or viability of the business? We await Wadsworth’s next steps. In the meantime we are exploring registering it as a community asset as its use ‘furthers the social wellbeing / social interests of the local community’ and hopefully this would afford some protection against change of use.
